Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Scalabl.io website and platform (the "Service") operated by Scalabl.io ("Scalabl", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By using the Service you confirm that you are at least 18 years old, you have the legal capacity to enter into these Terms, and, if you are using the Service on behalf of an organisation, you have authority to bind that organisation. These Terms, together with our Privacy Policy, form the agreement between you and Scalabl.

2. Description of the Service

Scalabl is a multi-tenant software-as-a-service platform that lets users build landing pages, forms, and funnels; capture, route, and manage leads; sync with third-party CRMs; and view marketing-analytics dashboards drawn from connected ad platforms. Specific features available to you depend on your subscription plan and the integrations you configure.

3. Accounts & Eligibility

  • You are responsible for the security of your account credentials and for all activity that occurs under your account.
  • You must provide accurate and current information when registering, and update it as needed.
  • You may not share your account or transfer it to another party without our written consent.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraud, abuse, or illegal activity.

4. Acceptable Use

You agree not to, and not to permit any third party to:

  • Use the Service to transmit unsolicited bulk email, deceptive content, malware, or unlawful material.
  • Interfere with, probe, or disrupt the Service, its infrastructure, or other users' accounts.
  • Attempt to reverse engineer, decompile, or extract source code from the Service except to the extent expressly permitted by law.
  • Resell, sublicense, or otherwise commercially exploit the Service outside the scope of your subscription.
  • Use the Service in a way that violates the policies of any third-party API or platform we integrate with, including (but not limited to) Google, Meta, TikTok, LinkedIn, Microsoft, ActiveCampaign, and GoHighLevel.

5. Your Content

You retain ownership of all content (including landing pages, form data, leads, and creative assets) you upload, create, or import into your workspace ("Customer Content"). You grant Scalabl a worldwide, non-exclusive, royalty-free licence to host, store, transmit, and process Customer Content solely as needed to provide the Service to you. You are responsible for ensuring you have the rights and consents necessary to upload Customer Content and to collect and process leads through the Service.

6. Third-Party Services & Google APIs

The Service integrates with third-party APIs and platforms (including Google APIs such as Sign in with Google, Google Ads, Google Analytics, and Google Search Console). When you connect a third-party account, you authorise Scalabl to access that account on your behalf only to the extent necessary to provide the connected feature.

Scalabl.io's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for full detail on what we collect, how we use it, and how you can revoke access.

Use of any third-party service through Scalabl is also subject to that service's own terms. Scalabl is not responsible for the availability, accuracy, or actions of third-party services.

7. Subscription, Fees & Payment

  • Paid plans are billed in advance for each subscription term in the currency stated at checkout. Fees are non-refundable except as required by law or expressly stated in your order.
  • Your subscription renews automatically at the end of each term unless you cancel before the renewal date.
  • We may change pricing for future renewal terms with at least 30 days' notice. Changes do not affect your current paid term.
  • You are responsible for any taxes that apply to your subscription, except for taxes on Scalabl's net income.
  • If a payment fails, we may suspend access until the balance is settled.

8. Cancellation & Termination

You may cancel your subscription at any time from your account settings or by emailing teaminsighter@gmail.com. Cancellation takes effect at the end of your current paid term. We may suspend or terminate the Service (or your account) if you materially breach these Terms, fail to pay, or use the Service in a way that creates legal or security risk for us or others. On termination, your right to use the Service ends and we will delete your account data in line with the retention rules in the Privacy Policy.

9. Intellectual Property

Scalabl retains all right, title, and interest in the Service, including its software, design, and trademarks. We grant you a non-exclusive, non-transferable right to access and use the Service in accordance with these Terms during your subscription. You retain rights to your Customer Content; we retain rights to our platform and any feedback you provide.

10. Privacy

Our Privacy Policy describes how we collect, use, store, and share information. By using the Service you agree to the practices described there.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements or that any data, including data fetched from third-party APIs, will be complete, accurate, or timely.

12. Limitation of Liability

To the maximum extent permitted by law, Scalabl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid Scalabl in the 12 months preceding the event giving rise to the claim, or NZD 100, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold Scalabl harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your Customer Content, your violation of these Terms, or your violation of any third-party rights or applicable law.

14. Changes to the Service or Terms

We may modify or discontinue the Service (or any feature) at any time, with reasonable notice for material changes that adversely affect paid customers. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, notify you by email or in-product notice. Continued use of the Service after the changes take effect means you accept the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of New Zealand, without regard to conflict-of-laws rules. The courts of New Zealand have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, and you submit to that jurisdiction.

16. General

  • Entire agreement. These Terms and the Privacy Policy form the entire agreement between you and Scalabl regarding the Service.
  • No waiver. Failure to enforce any right or provision of these Terms is not a waiver of that right.
  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
